The Federal Customs Service of Russia has approved a new procedure for excluding legal entities from the register of customs representatives. The order comes into force on September 19, 2026.
A registry is an admission to a profession. A company included in it has the right to perform customs operations on behalf of and on behalf of the declarant: submit declarations, make payments, and correspond with the customs authority. Exclusion from the register deprives this right, and it does not happen gradually, but from the date of the decision.
The grounds for exclusion are known and are primarily related to non-compliance with the conditions for inclusion: ensuring the fulfillment of duties, the absence of arrears in payments, the availability of customs operations specialists with valid qualification certificates, and compliance with non-disclosure requirements. The new procedure describes the sequence of actions of the department and the deadlines for each step.
For the customs representative himself, the value of the document lies in predictability: it becomes clear at what stage he receives the notification and how much time remains to eliminate the violation before making a decision.
For the importer, the risk lies in a different plane. Companies usually work with one broker and transfer the entire cycle to it: preparation of declarations, electronic signature key, communication with the post, payments through their personal account. The exclusion of a representative from the registry ends this scheme instantly. At the same time, the goods can already be in a temporary storage warehouse, where every day of storage is paid for, and after the expiration of the period, compulsory registration begins.
Proper preparation takes one working day. Check the status of your customs representative in the FCS registry and record the date of the check. Check with the broker if there are any applicable regulations and if there is enough collateral. Sign a framework agreement with a replacement representative in advance: it is cheaper to sign documents and transfer powers of attorney in a quiet mode than to look for a replacement on the day when the shipment is on its way. And keep copies of all the documents on current supplies with you — contracts, invoices, permits — so that the new broker can assemble the kit without the participation of the previous one.
