The mechanism for the automatic formation of resolutions on cases of administrative offenses will be fully operational on September 1, 2026. Amendments to the Administrative Code were introduced by Federal Law No. 120-FZ dated 05/02/2026.
The design is arranged as follows: the violation is recorded according to the marking system, the electronic resolution is generated automatically. No protocol is drawn up, the violator's participation is not required. The seller learns about the fine from the prepared document.
The automatic mode is applied to three trains. Ignoring the licensing regime for the sale of expired goods — 10 thousand rubles per unit for sole proprietors and 20 thousand for legal entities. Violation of minimum and maximum prices for tobacco and nicotine—containing products - from 5 to 500 thousand rubles, depending on the volume of sales per day. The sale of such products by a seller who is not registered with Honest Sign costs 50,000 rubles if more than ten units are sold at one checkout per month.
The first line-up hits everyone who sells labeled goods. Permissive mode means that the cashier checks the code before breaking through and does not skip an overdue position. The fine is calculated individually: a batch of twenty expired units gives the legal entity 400 thousand rubles.
The system is currently operating in a pilot mode in all regions of the Russian Federation. Honest Sign creates draft resolutions based on real data, and specialists from the territorial departments of Rospotrebnadzor study the materials and sign the documents. Fines have not yet been awarded to turnover participants — the mechanism is being debugged, failures are being fixed and employees are being trained.
The date of September 1 coincides with other requirements for labeling and permits, and this makes preparation urgent.
What a business should do. Check whether the cashier is working out the permissive mode correctly: the main risk is not in intent, but in integration failure when expired goods physically break through. Make an inventory of the remaining shelf life by the end of August. Importers of labeled groups need to make sure that the information about the introduction into circulation is fully transmitted: the discrepancy in the system now turns into a resolution without talking to the inspector.
