Federal Law No. 315-FZ of 08/04/2026 simplifies the registration of a machine-readable power of attorney for signing documents with an electronic signature.
Currently, the procedure is as follows: a power of attorney is drawn up in Public Services only when there are no special forms in other sources. Special forms can be published in other state and municipal systems — for use within them, on the website of the Central Bank of the Russian Federation for powers of attorney from financial market participants, on the FNP website for notarial powers of attorney. The representative must first find out where exactly the appropriate form is published.
Starting from September 1, 2027, the structure will be turned over. The form from Public Services becomes applicable in all cases, and the remaining forms receive the status of additional ones. The company will be able to issue one power of attorney and use it everywhere.
For participants of foreign economic activity, the topic is applied. A machine—readable power of attorney is what an employee or customs representative uses to confirm the right to sign documents on behalf of an organization with a qualified electronic signature. It is needed for electronic declaration, work with the Federal Tax Service, filing reports and exchanging legally relevant documents. Different forms for different systems created an unnecessary operational burden for companies whose representatives work in several circuits at once.
Another change concerns obtaining a certificate: when applying to an accredited certification center for a qualified certificate, a Russian organization must provide, among other things, its INN.
What a business should do. Until September 2027, the procedure is the same, so in the near future, only the set of documents will change when contacting the certification center. It makes sense for companies with several representatives to describe in advance which powers of attorney are used where, so that after the transition they are not randomly reissued. Customs representatives and brokers should include a single form in the regulations for working with clients.
